SENATE CONCURRENT RESOLUTION NO. 28
(Originating in the Committee on Finance)
Requesting the joint committee on government and finance to make a
study of the current state of the law in West Virginia that
permits the citizens of this state to receive retirement
benefits from more than one governmental pension plan.
Whereas, Many persons in this state are receiving retirement
benefits from more than one unit of the state or federal
government; and
Whereas, In many cases, this may be an unjust distribution of
governmental retirement benefits; therefore, be it
Resolved by the Legislature of West Virginia:
That the joint committee on government and finance is hereby
requested to review, examine and study the current state of the law
in West Virginia that permits the citizens of this state to receive
retirement benefits from more than one governmental pension plan
and the ways and means to provide for the fair and just
distribution of those governmental retirement benefits in this
situation; and, be it
Further Resolved, That the joint committee on government and
finance report to the regular session of the Legislature, 1997, on its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the joint committee on
government and finance.
